Lasting Powers of Attorney

How much does a Lasting Power of Attorney cost?

There are two parts to the cost of a Lasting Power of Attorney: the government's registration fee, which everyone pays unless they qualify for help, and the cost of getting the forms prepared, if you choose not to do them yourself. Here's what each one costs in 2026.

The short answer

The OPG registration fee

An LPA can't be used until the Office of the Public Guardian has registered it. According to GOV.UK, applying to register an LPA costs £92. If you want both a health and welfare LPA and a property and financial affairs LPA, it costs £184 in total, because each one is a separate document with its own fee.

The fee went up from £82 to £92 in November 2025. If you've seen £82 quoted elsewhere, that information is out of date.

For a couple who each want both types, that's four LPAs and £368 in registration fees. You can pay the OPG by credit or debit card, or by cheque made payable to "Office of the Public Guardian".

Getting a reduction or exemption

GOV.UK says you can apply for a reduction if you earn less than £12,000. You might be able to get an exemption (no fee at all) if you're on certain benefits, such as Income Support. You apply on the OPG's reduction and exemption form, which sets out the full eligibility rules and the evidence you'll need. It's the person making the LPA (the "donor") whose income and benefits count, not the attorneys'.

If the OPG finds a mistake

If there's a mistake in the application, the OPG may let you correct it and apply again within 3 months for £46, depending on the type of mistake. Some mistakes, particularly around signing and witnessing, can mean starting again with new forms. Getting the paperwork right first time is the cheapest option by far.

How long registration takes

GOV.UK says registration takes 8 to 10 weeks if there are no mistakes in the application. Before you apply, you send a notice (form LP3) to anyone you've named as a "person to notify". They have 3 weeks to raise concerns with the OPG. It's worth starting well before you think you'll need the LPA: once a person has lost mental capacity, it's too late to make one.

What does it cost to have an LPA prepared?

You can make an LPA yourself using the government's online service or paper forms. Many people do. Others prefer to have it prepared for them because the forms involve choices that are easy to get wrong. These include how attorneys make decisions together, replacement attorneys, instructions and preferences, and the strict order in which everyone has to sign.

Why it's worth paying for now rather than later

If someone loses mental capacity without an LPA in place, their family usually has to apply to the Court of Protection to become a "deputy". GOV.UK lists a £432 application fee, a further £266 if the court decides a hearing is needed, a £100 assessment fee for new deputies, and an annual supervision fee of £320 (or £35 for minimal supervision). A deputy might also need to pay for a security bond. The process takes time, and the court decides who is appointed. Our guide on what happens if you don't have an LPA explains more.

Frequently asked questions

Is the £92 fee per person or per LPA?

Per LPA. A health and welfare LPA and a property and financial affairs LPA are separate documents, so making both costs £184 in registration fees.

Do I pay the OPG fee to you?

No. The registration fee is paid to the Office of the Public Guardian when the LPA is sent for registration. It isn't part of our price, and we don't add anything to it.

Can I get the OPG fee refunded if my LPA is rejected?

OPG fees aren't ours to refund. If the OPG lets you correct a mistake, reapplying within 3 months costs £46. If the mistake was a drafting error we made, we pay that fee and redraft for free.

Can my attorneys pay the fee?

Anyone can pay the fee, but any reduction or exemption is based on the circumstances of the person making the LPA (the donor).

Has the law on LPAs changed?

The Powers of Attorney Act 2023 will eventually bring in a more digital process, but as of October 2026 LPAs are still made and signed on paper in the usual way. We'll update this guide if that changes.
