Terms of service
Last updated: 23 October 2026. [DRAFT for review. These terms have not yet been checked by a solicitor or professional body. Please have them reviewed (for example by a solicitor, or by your professional body once you join one) before launch, and make sure they match how you actually work.]
These terms explain how we provide our services to you. Please read them before you instruct us. We'll also send you a client care letter confirming exactly what you've asked us to do and the price. If the client care letter and these terms differ, the client care letter applies to your matter.
1. Who we are
LPA Direct ("we", "us") provides this website and service. You can contact us by email at info@lpadirect.co.uk.
We are a will-writing and LPA preparation service. We are not solicitors and we are not authorised or regulated by the Solicitors Regulation Authority or any other legal regulator. Writing wills and preparing Lasting Powers of Attorney are not "reserved legal activities", so they can lawfully be provided by people who are not solicitors. We do not give regulated financial, investment, pensions or tax advice.
We only provide services for people whose wills and LPAs are governed by the law of England & Wales. We don't cover Scotland or Northern Ireland, which have different laws.
2. Our services and prices
Our prices are fixed. We confirm the price on your free call back and in your client care letter before any work starts. No VAT is charged (LPA Direct Ltd is not VAT registered).
| Service | Price |
|---|---|
| Couples bundle (Mirror wills + 4 LPAs) | £599 |
| Single bundle (Will + 2 LPAs) | £299 |
| Lasting Power of Attorney (Property & Financial Affairs or Health & Welfare) | £149 per LPA |
| Mirror wills (Couples) | £99 |
| Single will (One person) | £59 |
| Optional extra: Printed and posted to you | £14.99 |
| Optional extra: Executor pack | £49.99 |
| Office of the Public Guardian registration fee (paid by you to the OPG, at cost) | £92 per LPA |
| OPG fee to resubmit a corrected LPA within 3 months, if needed (paid by us if the rejection is due to our drafting mistake, otherwise by you) | £46 |
- Single will: a will for one person. Mirror wills: two wills for a couple that leave things to each other and then on to the same people.
- Lasting Power of Attorney (LPA): priced per LPA. There are two types: Property & Financial Affairs, and Health & Welfare.
- Bundles: the single bundle is a will plus both LPAs for one person. The couples bundle is mirror wills plus all 4 LPAs (both types for each of you).
- Print and post (£14.99): we print your final documents and post them to you, with the signing guide, so you don't have to print them yourself.
- Executor pack (£49.99): a secure record for your executors of your personal details, bank accounts, insurance policies, pensions and other finances, so they can find everything, plus your funeral wishes and personal wishes. We prepare it from the information you give us. It is not a legal document, it does not replace or change your will, and your wishes in it are not legally binding. You are responsible for keeping it up to date. Please never include passwords, PINs or full card numbers.
- OPG fees: the Office of the Public Guardian (OPG) charges £92 to register each LPA, and £46 if a corrected LPA has to be resubmitted within 3 months. These are government fees, not our fees. You pay them directly to the OPG when you send your LPA. The one exception: if the OPG rejects an LPA because of our drafting mistake, we pay the £46 resubmission fee (see section 8). Reductions or exemptions may apply, and we'll point you to the OPG's form. If the OPG changes its fees, the OPG's current fee applies.
More complex estate planning (for example trusts, business property, foreign assets or complex family situations) is available on request at a price we'll agree with you in writing first. Where something is outside what we do, we'll tell you and suggest you speak to a solicitor or other specialist (see section 4).
3. What's included
- A free, no-obligation 15-minute call back, at a time of day you choose, to understand what you need and confirm the price.
- An instruction appointment by phone or video to take your instructions.
- Professional drafting of your will(s) and/or LPA(s) based on your instructions.
- Your drafts sent to you by email to check, with free changes until you're happy to sign.
- Your final documents sent by email with clear, step-by-step instructions for printing, signing, witnessing and posting them (or printed and posted to you if you buy print and post). We don't supervise or check the signing of your documents (see section 5).
4. What's not included
- Legal advice beyond the drafting of your documents. We explain your options and draft documents to carry out your wishes, but we don't advise on disputes, litigation, property transactions, divorce, or any area of law other than the wills and LPAs we prepare for you.
- Financial, pensions, investment or tax advice. We can explain in general terms how inheritance tax allowances work in a will, but we don't give regulated advice. Please speak to an independent financial adviser or tax adviser for that.
- Our free online tools (including the 2027 pension inheritance tax checker, the LPA quiz and the will check) give general information only. They are not advice, and their results are illustrative estimates based on the figures you enter and the rules as we understand them at the time.
- Complex matters. If your circumstances need specialist advice (for example significant trusts, business or agricultural relief, assets abroad, a likely challenge to your will, or concerns about capacity), we may refer you to a solicitor or other specialist, or decline to act. If we decline before drafting starts, we'll refund anything you've paid for the work we can't do.
- Storing your documents. We don't offer a storage service. You are responsible for keeping your signed original will and LPAs safe and telling your executors and attorneys where they are. We keep a working copy only as set out in our privacy policy.
- Probate, estate administration, deputyship applications, registering your LPA on your behalf, and acting as executor or attorney.
5. Your responsibilities
- Accurate information. Please give us complete and accurate information (names, addresses, assets, family details and your wishes) and tell us promptly about anything that changes. Your documents depend on what you tell us.
- Reading your documents. Please read your drafts carefully and tell us if anything is wrong or unclear before you sign. Signing confirms the documents reflect your wishes.
- Signing and witnessing correctly is entirely your responsibility. Wills and LPAs must be printed and signed on paper. We email your documents with clear, step-by-step signing instructions; you print them, sign them with the right witnesses (and, for LPAs, your certificate provider and attorneys) and post them yourself (LPAs go to the OPG). We do not attend, supervise or check the signing or witnessing of your documents, and we don't check signed documents before you post or store them. A will must be signed by you in the presence of two independent adult witnesses who are present at the same time, who then sign in your presence. A witness (or their husband, wife or civil partner) must not benefit under the will. LPAs must be signed in the order set out in the guide, with the witnesses and certificate provider described there.
- Documents invalid or rejected because of signing. We are not liable for a will or LPA that is invalid, rejected or ineffective because of how it was signed, witnessed or dated, because it wasn't posted in line with our instructions, or because pages were changed, removed or added after we sent them. If you're unsure about any step, please ask us before you sign: we're always happy to explain the instructions.
- Your own decisions. You must be making your own decisions freely. We may need to speak to you on your own, and we may ask to verify your identity. We may decline to act, or pause work, if we have concerns about capacity, pressure from others or the accuracy of instructions.
- Keeping documents up to date. Your will and LPAs reflect your circumstances and the law when they're made. You should review your will after major life events (for example marriage or civil partnership, which usually cancels an existing will, divorce, children or grandchildren, or moving home) and at least every 5 years.
6. Payment
Payment is due in full when you instruct us, by card or bank transfer. We'll confirm the amount and how to pay in your client care letter. Paying on instruction doesn't affect your 14-day right to cancel (see section 7).
Prices for optional extras are payable when you add them. OPG fees are paid by you directly to the OPG, not to us. We'll send you a receipt for every payment.
7. Cancelling and our 14-day money-back promise
Because you buy from us remotely (by phone, video, email or online), you have a legal right under the Consumer Contracts Regulations 2013 to cancel within 14 days of the day our contract is made (the day you instruct us and we confirm it in your client care letter). Our promise works alongside that right:
- If we haven't started work: if you cancel within the 14 days and your instruction appointment hasn't taken place, we'll refund everything you've paid, in full.
- If you've asked us to start sooner: we won't start work (your instruction appointment or drafting) during the 14 days unless you expressly ask us to; we'll ask you to confirm this in writing. If you then cancel within the 14 days, we'll keep a fixed, fair charge for the work already done, depending on the stage reached when you tell us, and refund the rest:
Example: on the couples bundle (£599), cancelling after your appointment means we keep £179.70 and refund £419.30; cancelling after your drafts are sent means we keep £479.20 and refund £119.80. The percentages apply to the price of the service you cancel; any optional extras we haven't supplied yet are refunded in full. When you cancel What we keep Refund Before your instruction appointment Nothing Full refund After your instruction appointment, before your drafts are sent 30% of the fee The other 70% After your drafts are sent, before your final documents are sent 80% of the fee The other 20% Once your final documents are sent The full fee No refund: your right to cancel has ended (see below) - Once your final documents are sent: your right to cancel ends when we've sent you your final documents, provided you expressly asked us to start within the cancellation period and acknowledged that you'd lose your right to cancel once the service is complete. There's no refund after this point.
- OPG fees you've paid to the Office of the Public Guardian are non-refundable by us, because they're paid to the OPG, not to us. Ask the OPG about its own refund rules.
To cancel, email info@lpadirect.co.uk, telling us clearly that you want to cancel. You can use the model cancellation form below, but you don't have to. We'll refund you within 14 days of being told, using the method you paid with.
Model cancellation form
To LPA Direct Ltd, info@lpadirect.co.uk:
I/We hereby give notice that I/We cancel my/our contract for the supply of the following service: ……
Ordered on: ……
Name of client(s): ……
Address of client(s): ……
Signature of client(s) (only if this form is sent on paper): ……
Date: ……
After the cancellation period, you can still stop at any time. We'll keep a charge for the work done using the same stages as the table above, and refund the rest. We may end the contract if you don't give us the information we need for 3 months after we've asked for it; we'd tell you first and refund any amount for work not done.
8. Our LPA redraft promise
If the OPG rejects an LPA, or asks for it to be corrected, because of a drafting error we made, we'll redraft it free of charge and send it to you with instructions for re-signing and resubmitting. If the rejection is due to our drafting mistake, we also pay the OPG's £46 resubmission fee. Otherwise (for example a signing or witnessing mistake), you pay the OPG's fees, including the £46 resubmission fee. If the OPG requires a completely new application, its full registration fee may apply.
This promise doesn't cover rejections caused by signing, witnessing or dating mistakes, missing pages, information you gave us that turned out to be wrong, or objections from attorneys or people to notify. We'll still help you understand what went wrong, and we can redraft for a fee we'll agree with you first. We don't give refunds because an LPA has been rejected: our promise is to put it right. This doesn't affect your legal rights (see section 10).
9. How long it takes
We'll send your draft documents within 14 days of you instructing us and us receiving all the information we need from you. The 14 days start from the later of the day you instruct us (and pay) and the day we have everything we've asked you for, such as names, addresses and details of your wishes; we'll tell you promptly if anything is missing. We'll send your final documents within 3 working days of you approving the drafts. If we can't meet these times, for example because of events outside our control, we'll tell you and give you a new date. Once you post your LPA, the OPG's registration time is outside our control (gov.uk currently says 8 to 10 weeks if there are no mistakes).
10. Our responsibility to you
We will provide our services with reasonable care and skill. If we don't, you have rights under the Consumer Rights Act 2015, including asking us to put it right or, if we can't, a price reduction. Nothing in these terms affects your statutory rights.
- We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill.
- We are not responsible for loss that was not foreseeable, or for loss caused by: incomplete or inaccurate information you gave us; how your documents were signed, witnessed or dated, or their not being stored or sent in line with our instructions (signing and witnessing are your responsibility, see section 5); changes to your circumstances or to the law after your documents were finished; or tax outcomes, which depend on your circumstances and the law when you die.
- Our services are for private individuals. We are not responsible for any business losses.
- Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that by law can't be limited or excluded.
[Review point: you may want a financial cap on liability. For consumers, any cap must be fair and reasonable under the Consumer Rights Act 2015 and should match your insurance cover once you have it. Take advice before adding one.]
11. Complaints
If you're unhappy with our service, please tell us so we can put it right. Email info@lpadirect.co.uk, with your name, what went wrong and what you'd like us to do.
- We'll acknowledge your complaint within 2 working days.
- We'll look into it and send you a full written response within 14 days. If we need longer, we'll tell you why and when you can expect it.
- If you're still unhappy, you can ask for your complaint to be reviewed again by the LPA Direct team. [Once you join a will-writing professional body, add its complaints and independent dispute resolution scheme here.]
Because we're not solicitors, the Legal Ombudsman can't consider complaints about us. You can get free, independent advice from Citizens Advice (citizensadvice.org.uk, 0808 223 1133), and you can always take a claim to court.
12. Your personal information
We use your personal information to provide our services, as explained in our privacy policy. That includes the sensitive information in an executor pack, which we handle with extra care.
13. General
- Governing law: these terms are governed by the law of England & Wales, and the courts of England & Wales have jurisdiction.
- Changes to these terms: we may update these terms from time to time, for example to reflect changes in the law or our services. The version that applies to you is the one in force when you instructed us, as confirmed in your client care letter. We'll show the date at the top of this page.
- Events outside our control: if something outside our reasonable control delays our work, we'll tell you and do what we can to limit the delay. If the delay is long, you can cancel and we'll refund for any work not done.
- Transfer: we won't transfer our obligations to another business without telling you first. If you don't agree, you can cancel and receive a refund for any work not done.
- If a court finds part of these terms invalid, the rest still applies. If we don't enforce a term straight away, we can still enforce it later.
